Austrian Regulations – Housing Usage Categories

In Austria, residential properties can generally be divided into three usage categories:

  1. Erholungsgebiet (Recreational Area)
    Properties or projects with this designation have a rental obligation. Personal use, such as for vacations, is usually flexible and well organized in most projects. The main restriction is that permanent residence in these properties is not allowed.
  2. Zweitwohnsitz (Second Home)
    This designation generally comes with few restrictions. The property can be used for vacations, rented out, or for longer stays – permanent residence is theoretically possible. Note: In some federal states, such as Tirol, Salzburg, and Vorarlberg, tourist rentals in a Zweitwohnsitz are legally prohibited unless explicitly allowed in the zoning plan (Flächenwidmungsplan).
  3. Hauptwohnsitz (Primary Residence)
    This category applies to properties intended for permanent residence by local residents. Non-Austrians purchasing a Hauptwohnsitz must actually live there. This requires deregistering in their home country and registering in Austria. A Hauptwohnsitz may not be used as a vacation home or second property.
